CPTPP Duty free clearance of goods shipped from Australia to Canada

The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) is a free trade agreement that Canada shares with Australia. The agreement reduces barriers to trade and provides preferential duty free import between each other.

Proof of Origin

The key part of all trade agreements is ensuring the goods qualify under the country's specific rules of origin. Many incorrectly assume that if goods are sent from a qualifying country, they should qualify for duty-free status. Country of origin is not determined solely on where the goods are sent from.

Australian origin goods may qualify for duty free entry using a simplified origin declaration (see section below).

The country of origin rules have been simplified under CPTPP, but can still get complex. The guidelines for country of origin qualification include:

  • Goods are considered originating if they are wholly obtained, such as goods that are grown, raised, caught or extracted in Canada or a CPTPP country.
  • Goods are considered originating if they are produced in Canada or a CPTPP country entirely from originating materials.
  • Goods are originating if they are produced in Canada or a CPTPP country from non-originating materials that undergo production in Canada or a CPTPP country, such that the resulting good satisfies the applicable product-specific rule of origin. The value of the non-originating goods that are part of the originating product can be considered dutiable.

Duty-free import for parcels sent from Australia to Canada under the CPTPP

The amazing thing about the CPTPP is that parcels containing products valued less than CAD 3 300 do not require a certification of origin to claim CPTPP preferential tariff treatment.

Parcels containing goods valued under CAD 3 300 can be considered for duty-free status if the following is included:

  • A signed statement completed by the importer, exporter or producer certifying that the goods originated from a CPTPP country
  • This statement is required on the commercial invoice and we recommend adding an additional stand-alone statement / supporting document.
  • The goods must meet the origin rules. For example, marks to indicate that the goods are not a product of a CPTPP country will disqualify the goods and have issues related to mis-declarations.

Jet Worldwide helps Australian companies access the Canadian market through low cost parcel delivery and clearance programs for e-commerce parcels.

BENEFITING FROM CANADA'S FREE TRADE AGREEMENTS.

CPTPP proof of origin shipments to Canada from Australia high value

Preferential tariff or duty-free treatment can be obtained for qualifying Canada-origin goods that are accompanied by a "certification origin." The goods imported to Canada must originate and be exported from a CPTPP ratified country.

Read more: Understanding a certificate of origin and when it is necessary

Rather than a separate certificate of origin, a statement on the shipping documents - including the commercial invoice - can be used to qualify the goods for duty free preferential treatment.

The statement or certification must be provided by the exporter or producer and be presented at the time of import by the importer of the goods. This information can be included on any document accompanying the shipment (such as the Commercial Invoice) or on a separate document.
